One of two men arrested in Monday’s shooting at a packed Lawrence nightclub told police there was an “arrest of alien” warrant out for him when the two allegedly gunned down four people during an apparent birthday party, killing one of them.
It is unclear whether U.S. Immigration and Customs Enforcement was aware that Fernando Guerrero Lara was a suspected illegal alien when he and Johan Saintclair allegedly walked into La Guira Restaurant shortly after midnight and opened fire.
A “detainer has been placed on Fernando Guerrero-Lara,” said ICE spokesman Harold Ort, “and we are aware of Johan Manuel Saint Clair (sic) and will take appropriate action as the situation warrants.”
Both suspects gave police a Lawrence address when they were arrested after a car and foot chase early Monday. But Guerrero Lara, 27, also told police “he was a tourist from Oklahoma and had a warrant for arrest of alien paper dated Aug. 12, 2010.”
Steve O’Connell, a spokesman for Essex District Attorney Jonathan Blodgett, said he “had information related to the immigration status of one of the defendants, but it’s not releasable because, upon review, it constitutes” confidential criminal record information.
Both suspects remained hidden behind a partially closed door at their arraignment yesterday in Lawrence District Court as Assistant District Attorney Michelle Defeo described the terror the two allegedly rained down on what was supposed to be a happy night out for the victims.
Officers arrived to find panic-stricken customers fleeing the restaurant. Inside, they found several sobbing women leaning over a man screaming, “Help him! I can’t find a pulse!”
Officers found another man lying on the ground with a gunshot wound to the face and a woman with an apparent gunshot wound to the back of the head. A fourth victim, a waitress, was shot in both legs, police said.
“The club was trashed, with broken bottles and glass and chairs and tables thrown all over the floor,” the police report stated.
One witness told police she had been looking out her window before the shooting when she saw a car pull up. Three men got out, she told police, and the front passenger put a gun in his waistband.
Other witnesses told police they heard six shots fired, and officers found six spent .40-caliber casings at the scene.
In a surveillance video police later viewed, Saintclair allegedly was seen carrying the murder weapon, Defeo said.
A witness told police that about 20 minutes before the shooting, he saw a Hispanic man tear his shirt off as he screamed at a woman in the vicinity of a damaged BMW.
It was unclear whether the incident was connected to the shooting, police said, but the man who was shot dead had been driving the BMW.
