Ninety-eight percent of the illegal immigrants arrested between October 1, 2000 and September 30, 2005 were never prosecuted for entering the Untied States. Instead, nearly 5.3 million of 'em were given a free trip back to Mexico and given a second chance to not get caught.
These troublesome facts come courtesy of an Associated Press analysis of federal data, 2005 being the most recent data available.
In 2005, of the 1.17 million people who were inconvenienced by an arrest, only 30,848 were prosecuted.
The likelihood of an illegal immigrant being prosecuted is "to me, practically zero," said Kathleen Walker, president-elect of the American Immigration Lawyers Association.
But is prosecution even worth the time and effort?
While we all want a reasonable solution to this ever growing problem, the truth is that our judiciary system can't possible handle it in any capacity. Between prison space, the courts and the costs, it's just not practical.
About 1 million immigrants are inconvenienced each year before being let go.
The Justice Department has a lot to deal with, and with limited resources, has decided to focus more on the smugglers and those illegals with criminal records.
T.J. Bonner, the union chief for Border Patrol agents, said the most effective solution would be to dry up job opportunities in the U.S. by cracking down on employers who hire illegal immigrants.
Bonner has suggested the creation of an "idiot-proof" system that would account for the legal status of workers and prosecute those employers who outsource.
"It's much like our tax laws: People don't pay their taxes out of an overriding sense of citizenship; it's a healthy dose of fear," Bonner said. "For every person we catch, two or three get by us."
So how does the current law actually work?
Well, under federal law, if you come to the United States illegally, the crime is considered a misdemeanor, much like petty theft, public intoxication and vandalism. For first-time offenders, the punishment could be a fine or up to six months in prison.

United States Code, Title 8, Chapter 12, Subchapter II, Part VIII, §1325 - "Improper Entry by Alien," any citizen of any country other than the United States who: 1) Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or 2) Eludes examination or inspection by immigration officers; or 3) Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact; has committed a federal crime.
