Man pleads guilty to rape of 94-year-old woman at Palo Alto nursing home
Roberto Recendes faces a 17-year prison sentence after pleading guilty last week to raping and beating a 94-year-old woman at the Palo Alto Commons nursing home in 2002.
Recendes, 43, pleaded guilty to one count of sexual penetration by force, one count of elder abuse and to an enhancement of inflicting great bodily injury, said Santa Clara County District Attorney's Office spokeswoman Amy Cornell.
Prosecutors plan to drop a second enhancement -- committing the crimes during the commission of burglary -- when Recendes is sentenced in December.
He could have faced up to 25 years to life in jail if he had been convicted of all the charges and enhancements.
The case drew national attention in 2002 when Palo Alto police arrested Jorge Hernandez, a Gunn High School graduate who was 18 at the time, and got him to confess he committed the crimes. The victim had not seen her attacker, and Hernandez was exonerated later by DNA evidence.
The link to Hernandez's eventual freedom surfaced in 2004 when Recendes was convicted of domestic violence charges in Sunnyvale. A sample of his DNA was taken and he was deported to Mexico. Two years later, authorities matched Recendes' DNA to that found at the rape crime scene.
He was brought back to the U.S. in 2008.
At Recendes' preliminary hearing in December 2009, his former girlfriend identified a necklace discovered at the rape crime scene as his, and a Santa Clara County crime laboratory criminalist testified two hairs on the victim's blankets had DNA consistent with Recendes' DNA. One hair was a full match.
The defense argued during the hearing that the victim, now deceased, had said the attacker called himself "Manuel," and that although a watch and ring were found at the scene, Recendes rarely wore such items.
"Certainly we're satisfied and pleased that the DNA testing resulted in Recendes being identified as the perpetrator and we could not have prosecuted him without the assistance of the FBI," Deputy District Attorney Brian Welch said Monday. Welch prosecuted most of the case, but didn't see it through to the plea because he is working on another case.
Recendes is expected to be sentenced to 17 years in prison on Dec. 9.
