ALBANY -- An Albany County sheriff's deputy who shot and killed a Mexican man living in Albany earlier this year near the Albany International Airport won't face criminal charges, prosecutors said Tuesday.
A county grand jury cleared Deputy Vincent P. Igoe of any wrongdoing in the March 20 death of Marcos DeJesus Alvarez, a 36-year-old father of six from the Mexican state of Oaxaca, District Attorney P. David Soares said.
"The members of the grand jury considered all of the evidence presented to them over the past three weeks and determined that the use of deadly force by deputy Igoe was justified," Soares said. He thanked members of the grand jury, police and extended condolences to Alvarez's friends and family.
The case of Alvarez, an undocumented immigrant who worked local odd jobs so he could send money back to his family in Mexico, had raised questions about the use of deadly force by police.
Alvarez was walking alone after midnight on an unlit, dead-end road near the airport. Igoe, who was patrolling in the area, pulled over and asked Alvarez what he was doing. Police say Alvarez then threw a chunk of concrete and lunged at Igoe, who responded by shooting him twice in the torso from about 15 feet away.
An autopsy determined Alvarez had bled to death. He did not have any alcohol or drugs in his system at the time of his death. The shooting was not captured by surveillance video because Igoe did not activate his police car's emergency lights, which automatically turns on its camera.
Sheriff James Campbell sent his final report from the department's internal investigation into the shooting to Soares. Chief Assistant District Attorney David Rossi presented the case's evidence to the grand jury, which returned a vote of no bill, meaning it declined to indict.
Igoe, 35, returned to work in May after a psychologist cleared him to resume duty.
Alvarez had lived in Albany for about a year, and had been wiring as much as $500 every few weeks to his wife, those who knew him have said.
"This is a tragic case, but it is my hope that by looking at, and learning from, the facts leading up to this incident, as well as communicating with the Mexican Consulate, the Mexican community in the Capital Region and the family of Mr. Alvarez, we can help prevent tragedies like this from occurring in the future," Soares said.
