Three Mexican nationals sentenced to federal prison last week for unlawfully re-entering the country raised the number of such cases prosecuted by the U.S. attorney's office in Oklahoma City this year to 42.
That caseload is an increase from 13 re-entry cases in 2008 and 26 cases in 2009, said Bob Troester, spokesman for the office.
They rarely end in dismissals or acquittals, Troester said. The majority are referred by U.S. Immigration and Customs Enforcement investigators.
"Most of them end in pleas and most don't go to trial because they are here illegally," he said.
Those convicted can face up to 20 years in federal prison before being deported. The length of their sentence is based on past crimes. Many are barred from ever returning to the country.
Family breakups seen
Julia Summers, assistant federal public defender, said she's seen a marked increase in illegal re-entry cases as a part of her workload.
They now comprise about two-thirds of her total cases.
"It's a huge part of my caseload," she said. "And it's been increasing."
Nearly all of her clients charged with unlawful re-entry have families here. Many have spouses and children who are citizens or permanent residents, she said.
"Sometimes the tragedy of the family breakup is magnified enormously when the defendant has actually grown up in the U.S.," she said.
Crimes ranging from theft to a previous illegal re-entry conviction to murder and drug complaints are used by judges to determine the amount of time the offender will serve in federal prison.
