A federal grand jury has indicted four Las Vegas men on conspiracy and fraud charges for allegedly illegally obtaining more than $2.3 million in unemployment benefits in Nevada, the Department of Justice announced.
The defendants — Francisco Garcia, 40, Eloy Garcia, 32, Efrain Garcia, 40, and Nabor Garcia, 32 — each were charged with one count of conspiracy to commit mail fraud and 21 counts of mail fraud, according to a statement from the office of Daniel G. Bogden, U.S. Attorney for the District of Nevada. The indictment was returned to the federal grand jury Sept. 14 and unsealed Sept. 22.
In addition, Francisco Garcia was charged with four counts of money laundering and six counts of false representation of a Social Security number. Eloy Garcia was charged with one count of money laundering and making a false declaration related to a bankruptcy proceeding. Nabor Garcia was charged with one count of money laundering.
Authorities arrested Francisco Garcia and Nabor Garcia on Wednesday in Las Vegas, but the other two defendants remain at large, according to the statement.
From November 2007 to September 2009, the defendants allegedly recruited people with the promise of helping them obtain unemployment benefits in Nevada, even though the people weren't eligible for benefits.
With the understanding that the defendants would receive a cut of the unemployment benefits, the people gave the defendants their personal information so they could submit the fraudulent claims, officials said.
If the state couldn't verify the people's identities, the defendants submitted false notarized affidavits of identity, officials said.
The defendants allegedly told some people their unemployment claims were not accepted — and instead pocketed the money for themselves, officials said. In other cases, the defendants allegedly gave people a portion of the benefits and then claimed that their benefits ran out, even though the state continued paying the claims.
Francisco Garcia also allegedly laundered money from the unemployment compensation benefit scheme by buying four homes in Las Vegas between January 2008 and May 2009, one of which was purchased with Eloy Garcia.
The indictment also alleges that Nabor Garcia laundered money from the scheme by purchasing a home in Las Vegas in May 2009.
Each charge carries a $250,000 fine and a minimum five-year prison sentence, with the mail fraud charges imposing a minimum 20-year prison sentence, if convicted.
Francisco Garcia and Nabor Garcia were appearing before U.S. Magistrate Judge George W. Foley on Thursday afternoon.
