Illegal Alien Pleads Guilty In Fatal DUI Crash

NASHVILLE, Tenn. (AP) -- An illegal immigrant who killed a man and his 2-year-old son in a drunken driving crash in Nashville has pleaded guilty to two counts of vehicular homicide.

Jonathan Narvaez-Pena apologized to the family of his victims in Spanish during Tuesday's hearing in Nashville.

Prosecutors recommended an 8-year prison sentence on each count for a total of 16 years.

Narvaez-Pena was 22 at the time of the crash in October that killed 43-year-old Antoine Bumvu and his young son.

A Metro Police officer testified at a preliminary hearing that Narvaez-Pena admitted he had 10 to 15 drinks before he ran a red light at an intersection.

He has been flagged for deportation proceedings after serving his prison time.

Illegal alien arrested for keeping his girlfriend chained to an engine

Investigators believe the woman was held captive in her apartment, near 2900 West and 3500 South, for several days, possibly a week or more. When her boyfriend was home, she was allowed to roam freely in the apartment. But when he left, a chain was tied around her ankles, said West Valley police Capt. Tom McLachlan. The other end of the 20-foot dog chain was tied to a 6-cylinder engine in the closet, he said.

The chain was long enough for her to reach a restroom, but she could not leave the room. The door leading into the room had deadbolts on both sides, McLachlan said, and both were locked. The windows in the room were screwed shut so they couldn't be opened. Additionally, the apartment had no phone.

Last Friday morning, the desperate woman wrote "call 911" in the condensation on her window. The first floor window, which was in the back of the building, faced a neighboring trailer court. The nearest trailer was about 20 yards away.

Peter Erkelens, 32, who lives in that trailer, was just getting home from work when he saw the woman writing on her window with her finger, he said. He saw the message and was able to talk to the chained woman through the glass. He then called 911 using his mobile phone.

The woman talked to the man while her boyfriend was still in the house, McLachlan said. She barricaded the door with a dresser so he could not get in, he said.

When police arrived, they kicked in the front door of the apartment and broke out the glass from the back room. They found "a frantic woman crying," according to a Salt Lake County Jail report.

"After police told me she was chained to an engine block, I was kinda shocked and disgusted," Erkelens said. "Who does that?"

The woman told officers that her boyfriend, "beats her regularly, strangles her and doesn't let her leave." In addition to the engine block and chain, police also found padlocks and the two-way deadbolt lock "that was secured with a key from the inside and outside."

"The victim had injuries from being beaten, strangled and there were scratches on her lower legs where the chain had been attached," the jail report stated.

This is calculated on an average life span for each of those two Dignitaries. Younger Dignitaries who retire at an early age, will receive much more during the rest of their lives. Their cost for this excellent plan is $0.00. NADA... ZILCH... ZERO!!!

This little perk they voted for themselves is free to them. You and I pick up the tab for this plan. The funds for this fine retirement plan come directly from the General Funds; "OUR TAX DOLLARS AT WORK "!

From our own Social Security Plan, which you and I pay (or have paid) into, every payday until we retire (which amount is matched by our employer). We can expect to get an average of $1,000 per month after retirement. Or, in other words, we would have to collect our average of $1,000 monthly benefits for 68 years and one (1) month to equal Senator Bill Bradley's benefits!

Social Security could be very good if only one small change were made. That change would be to: Jerk the Golden Fleece Retirement Plan from under the Senators and Congressmen. Put them into the Social Security plan with the rest of us Then sit back... And see how fast they would fix it. Illegal aliens: a welfare nation

The Center of Immigration Studies has a new study out today on the illegal immigration situation, based on US Census data and using analytical methods accepted by the Pew Hispanic Center, the Dept of Homeland Security, the Census Bureau and other institutions. Among its findings:

+ Immigrants account for one in eight U.S. residents, the highest level in 80 years. In 1970 it was one in 21; in 1980 it was one in 16; and in 1990 it was one in 13.

+ Overall, nearly one in three immigrants is an illegal alien. Half of Mexican and Central American immigrants and one-third of South American immigrants are illegal.

+ Since 2000, 10.3 million immigrants have arrived — the highest seven-year period of immigration in U.S. history. More than half of post-2000 arrivals (5.6 million) are estimated to be illegal aliens.

+ Of adult immigrants, 31 percent have not completed high school, compared to 8 percent of natives. Since 2000, immigration increased the number of workers without a high school diploma by 14 percent, and all other workers by 3 percent.

+ The proportion of immigrant-headed households using at least one major welfare program is 33 percent, compared to 19 percent for native households.

+ The poverty rate for immigrants and their U.S.-born children (under 18) is 17 percent, nearly 50 percent higher than the rate for natives and their children.

+ 34 percent of immigrants lack health insurance, compared to 13 percent of natives. Immigrants and their U.S.-born children account for 71 percent of the increase in the uninsured since 1989.

+ The primary reason for the high rates of immigrant poverty, lack of health insurance, and welfare use is their low education levels, not their legal status or an unwillingness to work.

On the Corner, CIS's Mark Krikorian explains the welfare stat this way:

This isn't because they're plotting to rip us off, but because they're 19th century workers in a 21st century economy, and simply don't have the tools to support themselves. The result is government-subsidized immigration, with taxpayers footing the bill for all this "cheap" labor.

The report concludes that: "Even during the great wave of immigration at the turn of the 19th century, the immigrant population was much less than half what it is today." We simply are being swamped, and there should be a time out for assimilation. Yet as a liberal, Spanish-speaking friend admitted to me yesterday, in a conversation about what each side in the immigration debate is loath to admit, that on his pro-immigration side, "The uncomfortable truth is that Latino immigrants are not assimilating."

According to the data, in Texas, my state, 47 percent of all immigrants lack health insurance (versus 18.6 percent of native-born Americans). What do they do when they get sick? Go to public hospitals, and get treated at the taxpayer's expense. I do not favor turning away sick people, whatever their immigration status. But come on, we shouldn't be letting them in in the first place. What are our own citizens who lack health insurance, and who need public care, supposed to do? Stand in line behind citizens of other countries who are here illegally? It's not right. Similarly on the public schooling situation, I'm aware of a Texas public elementary school where a senior administrator admitted to native parents from the neighborhood that their kids were going to be kept behind because the school has so many Hispanic kids whose English skills are poor to non-existent that it affects the quality of the education for all kids. Is that right?

Shockingly, an estimated 50 percent of the foreign-born population of Texas are in this country illegally -- 7 percent of the total Texas population. Almost one in 10 Texans -- and half of all immigrants -- have no legal right to be in this country. And this isn't a serious crisis? Apparently not to my newspaper: as my Dallas Morning News colleague Mike Hashimoto points out, the NYTimes, USA Today and other major papers carried stories about the new study today, but we didn't.

Illegal Aliens Costs $300M Per Year

NASHVILLE, Tenn. - A new report puts a price tag on how much illegal immigrants cost Tennessee taxpayers.

It is close to $300 million every year, according to the study conducted the Federation for American Immigration Reform (FAIR), a nonprofit research group.

It contradicts a report by the state comptroller's office released in August that indicated undocumented immigrants boosted the economy and did not take jobs from any Tennessee workers.

Jack Martin's team of researchers at FAIR investigated the cost of illegal immigration in Tennessee.

"The largest category of expenses to the taxpayers is for the education of the children of illegal immigrants," Martin said.

The cost is $255 million each year for education from kindergarten through the twelfth grade and ESL programs. Martin estimates an additional $30 million is spent on healthcare and incarceration, bringing the total to $285 million.

How does this report differ from the state comptroller's report?

"One of the main differences the comptroller's report was also trying to calculate the value of goods and services provided by the illegal immigrants," Martin said. "And that doesn't really make any sense unless you're working on the assumption that those jobs wouldn't be done by Americans if the illegal immigrants were not taking those jobs."

Martin doesn't believe the immigrants are doing jobs Americans workers would not do.

"There's no job in the United States being done only by illegal aliens, so you know there are Americans working alongside illegal aliens," he said.

NewsChannel 5 assembled a small sampling of Nashville's Hispanic community to respond to the report.

"It's a growth," said Luis Sepulveda. "We have to have extra help to develop it. When they come here, whether illegal or not, makes no difference. They are extra labor that we need."

If Tennesseans are spending million to educate illegal immigrants is that really a bad thing?

"I will never consider investing on education as something that is detrimental to our growth and development," said Yuri Cunza, president of the Nashville Area Hispanic Chamber of Commerce.

"Everything has a negative and we can all say, well that person shouldn't have this, but we can also look at the positives," said Rachel Hernandez. "I think that sometimes with immigrants we're forgetting their part."

A Tennessee Department of Education spokeswoman said it's hard to estimate just how many children of illegal immigrants are actually in the state school system. Federal law prohibits school officials from asking about a student's immigration status.

Several lawmakers such as state Rep. Debra Maggart are calling for the state comptroller to deliver another report about illegal immigration.

Well, this is an absolute outrage of the highest order! Blood has been spilled in Canoga Park, California over the illegal alien issue and surprisingly to some it's not that of an illegal aliens, but that of an American patriot! Simply outrageous and I'm furious. You can watch the video below of the aftermath of the attack, it is not for the squeamish. Yes, it is blood and no it is not a simple drip of blood.

I say "surprisingly to some" that it's not an illegal aliens blood, because those of us who have been involved and covering this issue for years know that American citizens blood is being spilled on a daily basis at the hands of illegal aliens in this country. The general estimate is as few as 12 a day in this country are killed by illegal aliens, some say the number is as high as 25 on average!

You would not know that though if you believe people like George Bush who call these patriots calling for our laws to be enforced, vigilantes. You'll also hear the rhetoric from groups like La Raza and the Mexican government (isn't that redundant?) that these groups are racist and violent, yet time and time again the only violence is coming from the illegal aliens, communists and socialists. Eventually I believe the tipping point will be reached and they will receive the violence they so justly deserve if they continue to allow things like what happened in Canoga Park on November 3, 2007 to continue.

Reports are that some illegal alien thugs and their scumbag supporters showed up at a Home Depot day labor site protest to "counter-protest" members of Save Our State and No More Invasion. At the conclusion patriots were cornered and attacked as they left the event - led by an illegal alien who has threatened them at past rallies. One patriot was hit in the head with a rock, and illegal aliens picked up bikes and threw them at the member along with paint cans.

This is what happens when you protest peacefully as an American citizen in your own country and your government does absolutely nothing to enforce the law and remove foreign invaders from your soil! This is what has been stated by those of us against illegal immigration, including Save Our State and the Minutemen, time and time again, that these aren't just simply people coming here to work, but to physically take over our country.

If you can watch the video below as an American citizen and not be as outraged as I am right now. Not be as angry and furious at our government. Then you have absolutely not one single shred of patriotism in your body. These people are out there simply calling for our laws to be enforced and they are viciously attacked by these low life criminal scumbags!

This is not the first time that people have been pushed around at these rallies in California and the police have done nothing. They don't make arrests of the illegal aliens, they treat it as a joke. Well it is no longer a joke. Now we don't just have American citizens dying in their homes due to illegal alien murderers and rapists. Report: Illegal aliens caught stealing wildfire relief supplies

Six illegal immigrants who were suspected of stealing relief supplies from Qualcomm Stadium were arrested by Border Patrol agents after San Diego police stopped them Wednesday morning.

A woman who had been evacuated to the stadium told officers she saw the group load up two pickup trucks and a car with cots and other supplies, leave and then return, said police Sgt. Jesse Cesen~a.

When officers stopped them, a member of the group said they were being paid to take things of value from the stadium.

“They were stealing a lot of stuff,” Cesen~a said. “We took the stuff back and we escorted them out. They were stealing from the people in need.”

Because some members of the group spoke Spanish, officers called Border Patrol agents at the stadium for relief efforts. They determined the people were in the country illegally and arrested them.

Just looting the emergency aid no one else will loot.

Illegal alien accused of hit and run

An illegal immigrant with a history of drunken driving ran a red light and smashed into a car with five people Saturday, police allege.

Hilario Carlin Cardenas was booked into jail on five counts of endangerment and one count of leaving the scene of an injury accident, according to court documents.

Two occupants of a vehicle that Cardenas struck were taken to local hospitals to be treated for non-life threatening injuries.

Mesa police allege that Cardenas ran the red light at University Drive as he headed south on Country Club Drive at about 11:30 p.m.

He and his passenger fled but a witness helped police nab him a less than a mile away.

The arresting police officer reported smelling alcohol on Cardenas, who had bloodshot and watery eyes and admitted to drinking earlier in the evening.

A portable breath test, which isn't admissable at trial but good enough to get a court-ordered blood draw, registered a blood alcohol content of .18 almost four hours after the crash. The legal limit in Arizona is .08.

Cardenas was arrested in 2005 on a suspicion of extreme DUI, or a blood alcohol content of greater than .15, but he failed to show for court proceedings.

No laws broken as illegal immigrants obtain loans, buy homes

He lives in a two-bedroom house hard by the highway in Boston, with flowers out front and a grill in the back. He has raised two children, bought two cars, and filed federal and state income taxes every year.

He blends seamlessly into his neighborhood, except for one thing: This particular homeowner, with his 1,875 square feet of US soil, is an illegal immigrant from Colombia, one of possibly hundreds of thousands of such people nationwide who have grabbed a piece of the American dream.

Their very existence, now coming amid increasing attention on illegal immigrants from Washington policymakers, has sparked new calls for crackdowns on home lending, even as so many illegal immigrants are rising into the middle class and embedding themselves into their communities.

Critics of illegal immigration find it preposterous that unauthorized immigrants can own homes, calling them risky investments for banks. Immigrants counter that many of them are more stable than people think, and they are fueling investment in cities and towns.

"This place is full of people like me," said the man, 48. He spoke on condition that his name not be published because it is easily found in the Suffolk County Registry of Deeds, and he fears immigration officials would track him down. "They have houses because the banks gave them a loan."

Although they lack legal residency, the immigrants find ways to build credit and buy homes: They take jobs, pay bills, open bank accounts, and sign up for credit cards. Many even file tax returns each year using their real names, addresses, and identification numbers issued by the Internal Revenue Service. The IRS generally does not share the information with federal immigration agents.

Nothing in federal law prohibits illegal immigrants from owning homes. And banks can legally accept passports, tax identification numbers, and consular cards from people who want to open bank accounts or get home loans, according to the Comptroller of the Currency, a bureau of the US Treasury that regulates national banks.

The Boston homeowner from Colombia said a convergence of events allowed him to buy a $400,000-plus home through a Spanish-speaking broker in 2004.

First, he said, he obtained a real Social Security number and Massachusetts driver's license from the government in the early 1990s before security crackdowns. Then, he worked three jobs: making pizzas by day, cleaning office towers at night, and delivering soiled hotel linens to the laundry on weekends. To build credit, he opened a bank account and applied for Bank of America and Discover credit cards, which he always pays in full.

On the day he bought the home, he said, he paid $4,000 as a down payment, plus fees. Because of the low down payment, he said, he had a high interest rate of 7.8 percent, which he later lowered by refinancing.

Now, he just cleans office towers from 5 p.m. to 6 a.m. five days a week, netting $3,000 a month. He said he covers the $2,400 monthly mortgage with his salary, rent from a tenant, and help from family members who live with him.

He says the effort is worth it, and that he is confident that he can pay back the loan.

"The money you spend on rent is money that you lose," he said, with a dismissive wave of his hand. "Rent is a waste."

Another homeowner in a seaside town in Eastern Massachusetts, a 50-year-old construction worker here illegally from Ireland, said he used an IRS taxpayer identification number to buy a home worth nearly $400,000. Two years ago a friend referred him to a small, local bank that welcomed foreigners. Like the Colombian man, he said he pays all his taxes to the government.

"We're not sponging off the citizens of the United States," he said in a telephone interview. "I'm not a citizen, but I'm doing my part as a citizen."

Critics accuse banks of using legal loopholes to essentially sanction illegal immigration, and fear that immigrants who cannot speak English well - or who aren't financially savvy - would be easy prey for unscrupulous lenders.

US Representative John T. Doolittle, Republican of California, sought to crack down on loans to illegal immigrants this year when he pushed legislation to ban government-sponsored enterprises from giving out residential mortgages based on IRS taxpayer identification numbers.

The requirement passed the House in May as an amendment to another bill and is pending in the Senate.

"It just sort of makes a mockery of our system," Doolittle said. "You can own a piece of the American dream without being here legally."

Ira Mehlman, spokesman for the national Federation for American Immigration Reform, criticized mortgage lenders and others for selling loans to people who could be deported at any time. "It's another example of business ignoring the impact that illegal immigration has on society because they think they can make a buck off it," he said.

Mortgage bankers say they comply with federal laws, and often require additional records, such as letters from employers, to assess whether a borrower can repay a loan.

"It's not our bank members' job to determine immigration policy," said Corey Carlisle, senior director of government affairs at the Mortgage Bankers Association, a national organization representing more than 3,000 companies. "But . . . they don't want to make a loan to somebody that's not going to be able to repay it."

Lawyers and others say homeownership reveals a different side of illegal immigration - that of immigrants, often in low-income communities, paying taxes and often lowering crime.

"They're the same as everybody else. They don't want to keep paying rent," said lawyer Chris Lavery of the Irish Immigration Center, based in Boston. "People who are illegal immigrants live next door to you."

The man from Colombia said he and his family feel welcome on their block. The house is small but comfortable, with a dishwasher, microwave, and big-screen TV. On weekends, he likes to fire up the grill and share a beer with neighbors. He recycles paper and cans, like everyone else. A good-service award from the pizzeria he used to work in decorates his living room wall.

Buying a house in Boston was not part of the plan when he arrived in the early 1990s. Instead, he and his family scrimped to build a $70,000 three-bedroom flat in the Colombian city of Medellin, with sparkling views of the city's hills.

He returned to live there in 1997, but could not find work. Within months, he was back in Boston.

He still owns the apartment in Medellin, but had to rent it to someone else.

"Sometimes I feel like selling that house," he said, with a grin. "Then I would buy something [else] here."

Phoenix police officer murdered by illegal alien

AZCENTRAL.COM – Phoenix police officer shot, killed in jaywalking stop Officer Nick Erfle, a father of two and an eight-year-veteran with the Phoenix Police Department, was shot and killed this morning. One hour later, the suspect was shot and killed by another officer. The violent morning started at approximately 8:30 when two officers approached three people for jaywalking and obstructing traffic on 24th Street one block north of Thomas Road. Police say the officers then did a record check on the three – a man and two women – and found that the man had a misdemeanor warrant for his arrest for shoplifting in Tucson. Police found that the name given by the man was not his real name. Police later learned the suspect’s identity was 22-year-old Erik Jovani Martinez. When the officers tried to arrest Martinez, he shoved one, pulled out a handgun and fired several shots according to police reports. One officer was shot in the face and fatally wounded. His partner was not hit and chased Martinez south on 24th Street but could not return fire because there was too much traffic.

Thompson: Deport Illegal Aliens

ABC News' Christine Byun reports: Republican presidential candidate former Sen. Fred Thompson, R-Tenn., fleshed out his position on immigration reform while campaigning at a townhall meeting in Sioux City, Iowa Friday.

His loudest and most frequent applause came during a lengthy response to a question regarding the status of illegal immigrants living in the United States.

"If we catch illegal immigrants who are here, they need to be deported," Thompson said. "If they want to get back in the right way, get in line with everybody else."

He also called upon Mexico President Felipe Calderon to focus on building his economy.

"We love you, we want to be your friend, but we would ask you to examine your policies as to whether or not it's wise for your economy to be based on the exportation of your own people," he said.

Thompson's question and answer session was interrupted by his daughter, Hayden, who walked on stage when he was discussing "what had to be done" in the Middle East.

"Hello Sweetheart, I'll be finished in a minute," he smiled, as she clung to his left leg.

Illegal Aliens Are Hunting Our Children

Contrary to what President Bush claims, family values do stop at the Rio Grande for many illegal aliens. In fact since 1999, there have been more than 1,000,000 sex crimes committed in the United States by illegal aliens.

In addition to suppressing wages, driving drunk, bankrupting our hospitals, and over-crowding our jails and public schools, illegal aliens are preying upon our children. Using U.S. Department of Justice, Immigration, as well as state and local law enforcement data, the Violent Crimes Institute has determined that there are no less than 240,000 illegal alien sex offenders currently inside the U.S.

In Operation Predator sweeps conducted since July 2003 across this country, Immigration and Customs Enforcement agents nabbed over 8,500 foreign national child molesters and rapists. Many of these predators had been previously convicted of other crimes, and many had already been deported once.

The Americans For Legal Immigration Political Action Committee (ALIPAC) recently tracked child sexual assaults committed by illegal aliens. In a 30 day period, they recorded 27 assaults by foreign nationals illegaly inside the United States. The results are as follows:

3-YEAR-OLD RAPED BY ILLEGAL ALIEN UNCLE, OFFICIALS SAY

VICTORVILLE — A 3-year-old girl was found abused and bleeding Thursday night, and officials have arrested her uncle, an illegal alien, for child molestation.

Salvador Luna, 29, who was previously deported, was arrested on suspicion of sexual abuse of a child and was taken to the Victorville sheriff’s station where he underwent a physical examination, said Detective Ryan Collins.

The victim was originally admitted to Victor Valley Community Hospital around 7 p.m. after her mother found the girl bleeding inside their home on Rockrose Street, said Detective Sgt. Bob Hughes.

“Her injuries were significant enough that she had to be admitted,” Hughes said.

Around 6:30 p.m. the mother, father, the 3-year-old and her siblings were watching television in the parent’s room, a few doors down from where Luna was staying, Hughes said.

The girl went to Luna’s room for a piece of candy, and when she returned, a sibling took the candy from her, authorities explained. The girl again went into Luna’s room, hoping to replace the stolen sweets.

“She is in the uncle’s room for a while this time, long enough for mom to wonder where she was,” Hughes said. “When mom found the child she could see that she was visibly upset. Mom picks her up and when she put her down, now there’s blood all over mom’s shirt.”

The woman took the child to a neighboring home where the resident was a nurse to have the girl checked out. The nurse immediately dialed 911 and advised the family to stay away from the home until authorities arrived, said Karen Hunt, spokeswoman for the Victorville station.

Officials arrived at the home and had Luna in custody in under five minutes, Hughes said.

Luna had apparently changed clothes by the time officials arrived, so the home was closed off and searched for physical evidence, Hughes said.

In 2000, Luna was arrested in Ventura County on suspicion of annoying or molesting a child and sexual assault, said Detective John Wickum. It is unknown whether Luna was convicted, but the family said he was deported shortly after, officials confirmed.

“His criminal history drops off in 2001,and he re-surfaces again in 2006 with a DUI arrest in Victorville,” Wickum said.

Additional information came in that there could be as many as four other family members who have been past victims, but that remained under investigation on Friday, officials said.

Results of medical examinations on both the victim and Luna are still outstanding, but authorities believe they might shed additional light on the case.

“This is like the smoking gun of molestation cases. There are so many reports and investigations where it can take months to get to the bottom of things. It’s rare to catch something in progress and be able to respond and arrest the suspect immediately,” Wickum said.

Anyone who may have information about Luna is asked to contact the Detective Bureau at the Victorville station at 241-2911.

Luna is being held at the Victor Valley Jail on $250,000 bail, officials said.

Illegal alien charged with aggravated arson and aggravated vandalism

General Sessions Court Judge Bob Moon said the man charged with setting a fire in a downtown hotel is "an unwelcome undesirable" illegal alien.

Judge Moon told Bario Gomez, "Undesirables like you are not welcome in this country. You are a Latino terrorist who entered this country illegally and soon plotted significant personal injury and damage to the people and businesses in our community."

Authorities said Gomez is an illegal alien with no proof of identification. Officials also said he gave police a false name.

The INS placed a hold on Gomez, 20, after charges of aggravated arson and aggravated vandalism were filed against him.

Judge Moon told him, "It is undesirables like you who create many unjustifiable problems and prejudices upon the good people who enter this country legally in chasing a dream for a better life for themselves and their families.

"Mr. Gomez, you nor any other citizen from a foreign land has a right to enter this country; you simply have a privilege to enter this country through the proper legal channels.

"You are a domestic terrorist who is an imminent threat to the safety of our people and their property. You are also a supreme flight risk from justice. It is with duty, comfort and ease that I increase your bond significantly in an appropriate amount to insure your appearance in further proceedings and to insure the safety of this community."

The bond was raised from $30,000 to $1 million. The previous bond was set by Magistrate James Purple, which Judge Moon described as "another ludicrously low bond."

According to Arson Investigator James Whitmire, Gomez checked into the hotel with his girlfriend. Testimony by Whitmire and management officials indicated that Gomez placed a toaster filled with matches in a microwave oven in his room intending a massive "delayed burn."

Proof also showed that multiple towels were stuffed into the toilet in order to retard the water supply. The hotel manager testified that the towels were stuffed so deeply that the pipes had to be disassembled to remove them. She also stated that the room was severely damaged and vandalized.

Capt. Whitmire testified that "hundreds of people were evacuated, including children."

He said, "If the fire had established itself many families and children would have most likely lost their lives or been severely injured. Being on the fourth floor, the fire would have been difficult to contain."

NJ Orders Police, Prosecutors To Alert Feds When Illegal Immigrants Are Arrested

(AP) After a review driven by three brutal slayings, the state attorney general on Wednesday ordered New Jersey law enforcers to notify federal immigration officials whenever someone arrested for an indictable offense or drunken driving is found to be an illegal immigrant.

Attorney General Anne Milgram reviewed the state's policy in light of the execution-style killings Aug. 4 of three Newark college students and the wounding of a fourth victim. One of the six suspects was an illegal immigrant who had been granted bail on child rape and aggravated assault charges without immigration officials being alerted to his existence.

While saying she did not want to "Monday morning quarterback" the Newark case, Milgram said that if the policy had been in place when Jose Carranza was indicted on the prior charges, federal officials might have placed an immigration hold on him, meaning he would have remained in custody or bail might have been set higher because of his immigration status.

The killings highlighted the need "to have a uniform state policy on notification to immigration," Milgram said. Before the directive, "all police departments in our state had complete discretion as to if, when and how to notify immigration authorities."

The policy applies immediately to all state and local law enforcement and to prosecutors. It also specifies that police notify prosecutors and courts when illegal immigrants are arrested.

The triple homicide rocked Newark, a city already reeling from a 50 percent rise in the murder rate since 1998, and prompted an outcry over the lack of communication between local authorities and immigration officials.

The fact that Carranza, 28, an illegal immigrant from Peru, was out on bail after being accused of committing serious felonies also enraged some, including state Sen. Shirley Turner, who on Wednesday urged bail restrictions for accused illegal immigrants. The Democratic legislator proposes that illegal immigrants be required to post a full cash bail if they are charged with committing a crime in New Jersey.

A bail bondsman put up $150,000 for Carranza _ the lowest amount recommended for someone accused of sexually assaulting a child _ and he walked out of the Essex County jail in May. Seven months earlier, he had paid $2,000 to get out of the same jail after being charged with assault and weapons possession after a bar fight. He was allowed to put up 10 percent after a judge set bail at $20,000.

Authorities have said they did not know he was undocumented when those bails were set. Those bails have now been revoked, a largely symbolic move because Carranza, a day laborer, is now charged with three counts of murder and is being held in lieu of $1 million bail.

"I often see people back on our streets that I believe should not be back on our streets after they've committed serious crimes," Newark Mayor Cory Booker said. "I would be remiss if I wasn't calling for larger changes and larger reforms in the state of New Jersey and the United States."

Some have questioned whether a policy such as Milgram's could have prevented the schoolyard slayings, and suggested that a tougher approach could discourage illegal immigrants from reporting crimes. The directive, however, prohibits officers from checking the immigration status of crime victims, witnesses or people seeking police assistance.

Milgram treaded lightly on a federal law allowing local police to be deputized as immigration agents. She said that the practice will be allowed in New Jersey, but that deputized agents can perform immigration status checks only after someone is arrested for an indictable offense.

Suspected illegal aliens nabbed

Maricopa County Sheriff's deputies busted eight suspected illegal immigrants Wednesday in a Glendale house, where detectives were lead during the investigation of a homicide that occurred on Saturday.

The smuggler at the Glendale house was booked on numerous felonies, including kidnapping, according to a press release from the Sheriff's Office.

The case began Saturday from a tip on the Sheriff Office's newly installed hotline where tipsters can squeal on suspected illegal immigrants. The deputies went to a house in El Mirage where they found an illegal immigrant who had been beaten and shot

Newark Slayings Fan Hysteria Over an Illegal Alien Crime Wave

When Newark Mayor Cory Booker learned that the alleged shooters in the execution killing of three black college students were illegal immigrants, he did the responsible thing.

He did not finger point a porous border and lax law enforcement for allegedly letting so many supposed violent prone illegal immigrants slip into the country as the cause of the killings. Booker said, and did, the right thing as a responsible public official, and in this case a black elected official, who did not want to arouse public passions any more than they already were over the murders. He certainly did not want to inflame the fragile tensions between black and Latinos any more than they already are.

But others have not exercised the same restraint. Some black talk show hosts and black writers have burned up Internet sites, and sent of floods of emails (this writer got several) with outlandish and reckless charges that the killings were part of a concerted plot by Latino gangs to target African-Americans for murder and mayhem.

Leading immigration reform foes from Center for Immigration Studies to Bill O’Reilly also claimed that state and federal officials are so fear being branded racist that they have turned a blind eye to waves of illegal immigrants who supposedly have unleashed a violent crime wave across the country.

They gleefully add that Newark is a sanctuary city where police are forbidden to ask questions about a suspect’s citizenship status. There are arguable exceptions;the spate of violent clashes between black and Latino inmates in California’s prisons, and Los Angeles county jails last year, the headline-grabbing murders of black teen Cheryl Green last December, three other young blacks in Los Angeles. But there is no evidence that Latino gang members have embarked on a systematic campaign of ethnic
cleansing against blacks.

The second claim that illegal immigrants are uncorking a violent crime wave is easier to sell.

The movie industry and TV series such as The Untouchables, The Godfather, Scarface, Miami Vice, and The Sopranos have long fed the popular image of violent prone immigrants committing wreaking havoc in cities. And there are the endless tales of crime cartels like the mafia, Cuban marielitos, Colombian cocaine cartels, Japanese yakuza and Chinese triads that also spread terror.

The rumors were rife that the alleged shooters in Newark were connected with the Salvadoran Mara Salvatrucha (MS-13). This gang has received a lot of press lately as an immigrant drug and murder incorporated.

There is, however, no truth to the claim that illegal immigrants have unleashed a rampant crime wave in this country. There are more immigrants than ever in the U.S. and crime rates here have plummeted.

The plunge has been most notable in the big cities with the largest illegal immigrant populations. FBI figures show big drops in property crimes and violent crimes, particularly the homicide rates, during the past decade. The sole exception to this has been a spike up in black on black homicides. Few of the killers here are illegal immigrants.

Illegal immigrants whether juvenile or adult are far less likely to be incarcerated than native born Americans. That includes native born Latinos. But facts never got in the way of a good politically driven scare tactic to turn public opinion against any sort of meaningful immigration reform. It’s heartbreaking to see the falsehood about an illegal immigrant crim wave masquerade as fact in the Newark slayings.

Apart from the incidents of Latino on black violence cited earlier, and the Newark murders, black and Latino relations have not been marred by violence. Most of the violence in urban areas, and that includes Newark, have been black on black or Latino on Latino.

There is no evidence that the Newark killings were anything other than a random robbery attempt gone bad. Yet, the not-so-subtle inference that the killings are part of a targeted plot comes at a time when more blacks continue to voice fears that illegal immigrants are muscling them out of jobs, and competing for scare resources in health, public services and public schools. With 1930’s depression era levels of unemployment among young black males, and blacks making up more than nearly half of America’s record 2 million plus jail population, this is a concern that can’t be ignored.

The Newark slayings fuel fears among many blacks that they are losing ground to illegal immigrants and under siege from violent street gangs such as the Mexican Mafia and MS-13. The relatives of the three students gunned down in Newark demanded to know how one of the suspected shooters was back on a street with prior felony arrests. This is a legitimate question. They’re owed an answer. But they - and Booker - did the right thing by to not blame the death of their loved ones on bad immigration policies, or worse, feed the myth that illegal immigrants are America’s new gangsters. The pity is that others haven’t done the same.

A Fearsome Illegal Alien Gang and Its Wannabes

THE grim execution-style shootings that killed three college students in a Newark schoolyard two weeks ago bore many hallmarks of gangland slayings, and the culprits clearly wanted it that way.

Three of the four victims, two women and two young men aged 18 to 20, were forced to kneel facing a wall before being shot in the head. Both women, one of whom survived, were slashed in the face with a machete or knife. And the MySpace page of one of the six suspects, a 16-year-old who is still at large, pays loving homage to one of the country’s most feared and hyped gangs: La Mara Salvatrucha, or MS-13, a Central American gang that has become synonymous with bloodthirstiness.

The authorities in Newark swiftly noted that they had found no evidence linking the suspects to MS-13, or any other gang. “There’s a difference between a gang member and a wannabe,” Newark’s police director, Garry F. McCarthy, said last week in an interview with The New York Times.

Still, the possible connection gained a lot of attention. Be they real or imagined, the teenager’s ties to MS-13 underscored the potency of the gang’s name. MS-13’s notoriety has exploded in recent years, fanned by bone-chilling reports of its machete attacks, beheadings and the fatal stabbing of a pregnant teenager, as well as menacing photos of its members, their faces and torsos inked with tattoos. Newsweek christened MS-13 “The Most Dangerous Gang in America,” and National Geographic Explorer upped the ante with its documentary about MS-13, “The World’s Most Dangerous Gang.”

But in a way, the intense focus on MS-13 adds to its mystique and potency, providing a dangerous model for teenagers looking for trouble.

MS-13 was formed in Los Angeles in the 1980s by refugees from El Salvador, and the F.B.I. estimates the gang now has 10,000 members operating in cells or “cliques” in 42 states and an additional 50,000 members in El Salvador, Guatemala, Honduras and Mexico. Like other gangs, MS-13 initiates members by beating them. In 2004, the F.B.I. created the MS-13 National Gang Force to respond, the agency said, to the gang’s growing threat.

“MS-13 has the unique, unfortunate ability to replicate themselves in similar ways across the United States, exactly like a virus,” said Brian Truchon, the director of the task force. “It is known for its ability to operate between borders, to effectively communicate and move between Central America and the U.S.”

But critics question whether the federal government is overstating the gang’s reach. According to F.B.I. estimates, other gangs have far more members nationally. For instance, the agency puts membership in the 18th Street gang somewhere between 30,000 and 50,000; the Bloods at between 15,000 to 20,000, and the Gangster Disciples at between 50,000 to 100,000.

In February, a report by the Washington Office on Latin America, a nonprofit advocacy group, and the Autonomous Technological Institute of Mexico found few if any links between MS-13 members in Washington, D.C., and Central America and Mexico. Connie McGuire, the research and outreach coordinator of the nonprofit group, said there was no evidence of any organized network among far-flung members.

“Obviously there are individuals who need to be taken seriously who are committing serious crimes,” Ms. McGuire said. “But there’s been this portrayal of gangs as a menace that is spreading all over the continent.”

“From our understanding, that’s not the general trend,” she said.

Alex Alonso, an academic who tracks gangs in Los Angeles and runs the Web site streetgangs.com, says all the attention on MS-13 has only added to the gang’s mystique. As a result, Mr. Alonso says, MS-13 has displaced the Bloods and the Crips in the popular imagination, prompting copycat gangs to form. If you’re a rebellious 15-year-old yearning to join a gang, Mr. Alonso said, what could be more alluring than becoming part of the one that has been anointed the most dangerous in the country, or indeed the world?

“The feds are linking little gangs in places like South Dakota to a national network, when the kids probably never met MS-13 people,” Mr. Alonso said. “All they did was go on the Internet or to a magazine or newspaper and say, ‘That’s the gang we are.’ ”

And while insisting they do not dismiss the violence MS-13 has wrought, both Ms. McGuire and Mr. Alonso also claim that the heightened focus on the gang and other transnational gangs is related to the immigration debate.

“These gangs, and the way they are visually, make a really scary image of an ‘illegal immigrant,’ ” Ms. McGuire said. “It’s not a coincidence that in this moment of all these tensions around immigration issues that there are new policies about transnational gangs.”

But Mr. Truchon countered that the F.B.I. task force was formed before the federal government’s wrangling over the immigration bill came to a boil. And many MS-13 members are second- and third-generation immigrants, he said, and in the United States legally.

“Even if you shut the border tomorrow, what are you going to do about the ones that are here?” he said.

Certainly there is brutality. In two attacks in Fairfax County, Va., MS-13 members severed the fingers of two rival gang members. In 2003, members stabbed to death a pregnant 17-year old, Brenda Paz, on the banks of the Shenandoah River after discovering she was a federal informer.

Tales of MS-13 violence are even more gruesome in Central America, where gang members have been linked to beheadings, mutilations and the spraying of bus passengers with bullets.

Law enforcement authorities say there are proven connections between MS-13 cliques, both inside the country and out. In June, two MS-13 members were indicted for ordering murders in the United States from their cells in a Salvadoran prison. On Long Island in 2004, efforts were made to unite various cliques from the East and West Coasts, according to Robert Hard, a supervisory senior resident agent with the F.B.I.

The plans were disrupted, he said, after key members received various convictions. Also on Long Island, local cliques often convene for large meetings, called “universals,” said Michael Bolitho, a detective sergeant who investigates gangs with the Nassau County police.

Such findings, Mr. Truchon said, show that MS-13 merits all the federal and international scrutiny the gang is getting. It recently got more, when the White House announced that various federal agencies would be working with governments to the south.

“Even if there is some hyperbole built in, it’s a group that is dangerous and has to have someone looking at it,” Mr. Truchon said. “Are we adding to it? Maybe. But I don’t think we have any other options.”

Newark Triple Murder Fuels Debate on Treatment of Illegal Aliens

NEWARK, Aug. 17 — The radio advertisement, released after the killings of three young people here, starts with a few notes of music and an anonymous voice-over before Rudolph W. Giuliani speaks.

“It frustrates me that if someone comes here illegally,” Mr. Giuliani says as the music swells, “if they commit a crime, we don’t throw them out of the country.”

Among the motivations for the 60-second spot, part of Mr. Giuliani’s presidential campaign, was the revelation that a suspect in the Newark shootings, Jose Lachira Carranza, is an illegal immigrant from Peru who could have been detained by federal immigration authorities after he was arrested three times on criminal charges.

A national chorus reacted with horror to the Aug. 4 killings at a playground here, and Mr. Giuliani’s advertisement speaks for a prominent subset: those who have cited the shooting deaths to bolster their argument that the criminal justice system treats illegal immigrants too leniently.

Besides Mr. Giuliani, the former mayor and Republican presidential candidate, the critics have included Newt Gingrich, the former Republican House speaker. (“Far more Americans are being killed by violent, evil people here in America than in our official military ‘combat zones’ overseas,” he wrote in the National Review.)

And Representative Tom Tancredo, Republican of Colorado, is bringing his immigration-themed presidential campaign here on Monday for a news conference “to denounce the sanctuary city policy of Newark.”

Some of the loudest arguments have been over whether local law enforcement officials should check the immigration status of people they arrest and then report those who are here illegally to the federal authorities.

The question has become a flashpoint for municipal officials who are grappling with immigration. Some of them say routine immigration checks are among the few tools they have to deal with what is largely a federal issue. Others herald their cities as immigrant sanctuaries.

The mayor of Newark, Cory A. Booker, has tried to keep the public discussion focused on his main goal: reducing the crime rate. Mr. Booker said he was frustrated that Mr. Carranza had been freed, but, responding to the debate surrounding the suspect’s illegal status, has come out firmly against involving city police in immigration matters.

He said such a role would hurt relationships with what he called “the most marginalized and vulnerable people within our community.”

“My Police Department does not play an I.N.S. function,” Mr. Booker said. “We are not to be running around doing interrogations about whether someone is documented or not.”

Two reviews — one by New Jersey’s attorney general, the other by a retired judge appointed by the state’s chief justice — are looking at Mr. Carranza’s journey through the criminal justice system and examining whether mistakes were made; the immigration question is only one factor.

Mr. Carranza was first arrested in October 2006, in West Orange, N.J., on aggravated assault charges after a bar fight, and again twice earlier this year on charges that he raped a child in his care. After the October arrest, he was freed on $20,000 bail.

After the second arrest, in Orange, N.J., bail was set at $150,000, and Mr. Carranza was freed after posting it through a bondsman. Arrested again in May, in Newark, on additional sexual assault charges in the child rape case, bail was set at $300,000 but then lowered to $150,000, which Mr. Carranza had already posted.

In neither case did the arresting officers report Mr. Carranza’s immigration status to an Immigration and Customs Enforcement center that acts as a liaison with local officers. Neither did the prosecutors who were handling the two cases; their policy is to contact the immigration service only when cases are completed.

James M. Porfido, a former Morris County prosecutor who ran the county’s sex crimes unit and who is now a criminal defense lawyer, said that while the most violent offenders were usually held without bail, several of his clients who had been charged with first-degree sexual assault — as Mr. Carranza was — were held without bail.

Of Mr. Carranza, he said, “If I’m the prosecutor, he’s not going anywhere.”

It was only after his arrest on murder charges on Aug. 9 that Mr. Carranza’s immigration status was reported. After an employee in the Essex County Sheriff’s Office learned that Mr. Carranza’s Social Security number was fake, the immigration service issued a “detainer,” which gave federal agents the right to hold Mr. Carranza if and when local officials set him free.

The Carranza case involves two distinct issues: the release of Mr. Carranza on bail and the fact that local authorities did not notify federal officials about his immigration status. Gov. Jon S. Corzine of New Jersey has tried to untangle the issues.

“The issue of proactive immigration law enforcement is different than how you might deal with an individual that is, for some other reason, in the criminal justice system,” Mr. Corzine said at a news conference last week with Mr. Booker.

The debate, the governor added, is whether the Newark police should “be having people out enforcing the immigration laws and jamming the jails even more than what we have now, versus the issue of when someone has committed a felony and you have them in custody checking out their documentation.”

Asked whether the state would start checking immigration status, Mr. Corzine deferred to his attorney general, Anne Milgram. She has said that she will speak publicly about the issue soon.

In the New York City area, some leaders — including the mayor of Morristown, N.J. — have embraced a federal program known as 287 (g). The program, named for a section of the 1996 Immigration and Nationality Act, allows local officers to be deputized as immigration agents.

In other cities, mayors have moved in the opposite direction, formally declaring that local officials, including the police, will not ask about immigration status.

In Newark, the Municipal Council has adopted a nonbinding resolution that commits the city to being a “sanctuary” for immigrants.

But since the shootings, Ronald C. Rice, a councilman who is allied with Mr. Booker, has proposed an ordinance that would require the police to contact federal authorities about illegal immigrants in custody.

America's Most Wanted - Illegal alien William Roberto Santos is wanted for 10 counts of sodomy with a 10-year-old boy

William Roberto Santos worked as a laborer at a horse farm in Owensboro, Ky. Nobody seemed to know much about his past, but his behavior and personality quickly made him a trusted member of the community.

He attended church regularly, and parents felt safe leaving their young children in his care. One child in particular, who spent time at the same horse farm where Santos worked, spent four or five nights at a time at Santos' apartment.

Nobody had any reason to suspect anything sinister was going on until the 11-year-old boy confessed to his mother that something bad had happened, and that it had happened many times.

Even though Santos is in the U.S. illegally, cops do not think that he would return to his native home of Mexico.

An Abuse Of Trust

By the time the 11-year-old told his mother what had happened and the police were contacted, Santos was already gone. Through interviews with the victim and his mother, the police were able to establish that Santos had sodomized the boy multiple times over the course of two weeks.

Santos was also implicated by his gay lover, who went to the police and told them that Santos had confided to him what he had done to the little boy. Unfortunately, Santos did not tell his lover where he planned on going when he disappeared from Kentucky.

When the police went to Santos' apartment, they found he had left in a hurry, leaving most of his belongings behind. But nothing was able to point them towards where Santos was now.

Where Is He Now?

Police believe it is possible that Santos may be trying to find work at a horse farm in New York, perhaps near a racetrack. Cops say Santos used to talk about wanting to work near a large racetrack in New York, and think he might be trying to fulfill this wish.

There have been sightings of Santos in Phoenix and New Albany, Miss., but once again, there was nothing to lead police to his current location. Even though Santos is in the U.S. illegally, cops do not think that he would return to his native home of Mexico. Police say he has been ostracized by his family members in Mexico because of something he did to a young boy there before he moved to the United States.

Illegal border crossings are not victim less crimes. They are crimes of such magnitude they could destroy a nation. They have cost American citizens trillions of dollars in property devaluations, destruction of the social security fund, lost wages, benefit fraud, health care, identification theft and theft of government services and in so many other ways. The emotional toll is much greater. Many American Citizens have lost their families and their hope in this the greatest of all crimes ever committed against humanity.

Illegal border crossings are gateway criminal acts that engender other more serious crimes and broader corruption at all levels of government. A recent study in Colorado concluded that strict and timely enforcement of the death penalty had a positive influence on the other criminal acts that warranted capital punishment.

Kentucky Commonwealth Attorney Ray Larson indicates the new study conducted by an economics professor in Colorado, supports the idea of swift and sure punishment is a deterrent. The study reported that as many as 18 murders are prevented by timely capital punishment. The study was conducted over the last six years.

This procedure has been used as a behavior modification tool for centuries. That is how parents are taught to raise children.

The American system of justice is doomed to failure and anarchy when criminals are not punished for violating our laws. That is obvious and can be attested to by millions of illegal alien invaders and criminal employers in America who continue to openly violate American rule of law because they have been assured there will be no enforcement.

Immeasurable societal costs and loss of innocent lives are caused by repeat offenders released for murders and other high crimes. Criminal illegal aliens continue to overwhelm the American justice system because of inadequate enforcement of the rule of law and effective and timely punishment that at least equals losses suffered by the victims. That is the rudimentary definition of justice. The only way to stop them and their criminal employers is to provide motivation to assure they quit their criminal behavior.

The enforcement deterrence principle can be easily applied to the in excess of 43,000 American Citizen deaths and numerous other felony crimes committed by illegal aliens, criminal employers and government officials who aid and abet their crimes. Timely, consistent and guaranteed enforcement of existing laws will end illegal alien invasion and related widespread government and employer corruption.

We must enforce all our laws to assure our republic stands. Without a nation of laws we become a nation of men. Those with the power and money then define our form of government instead of “We the people.” So far the rule of men in America has defined a tyrannical form of government intent on replacing our republic with one world government.

Innocent American lives are squandered by criminally inept liberal elitists and now conservative employer elites who report they believe behavior of an inherently evil person can be changed by rehabilitative or restorative justice without punitive enforcement of the laws. Others report they believe illegal criminal acts of illegal aliens are justified because of past injustices suffered because of American policy. Others believe their crimes should be provided amnesty because they only want to steal economic benefits from American Citizens.

Those opinions are frequently changed when the act of evil committed by criminal illegal alien invaders comes into their lives and affects them directly. Those who commit criminal acts do so of their own volition. The following convincing and logical definition of evil as it relates to child molesters can be readily applied to those who chose to violate American rule of law under any circumstance. There is no justification for people to illegally violate sovereignty of a nation by illegal entry and then committing related crimes.

This Colorado study is a clear indication the only way to preserve the American Republic is by strict and sure enforcement of the rule of law. Illegal alien who injured judge flees the U.S.

A blind person could have seen this one coming.

An illegal alien who caused a crash that seriously injured a Pennsylvania judge has fled the U.S. to his native Guatemala to avoid prosecution. Surprise. Surprise.

How did the alien get out? He boarded a commercial flight in Newark, N.J., and landed safely in his home country, thumbing his nose all the way at the U.S. legal system and our homeland security bureaucracy. Incredible!

A judge issued a warrant for Rigobert Garcia-Ortega's arrest for failure to appear after Garcia-Ortega was a no-show at a pretrial hearing in Montgomery County Court Thursday.

This incident explains why so many Americans oppose the amnesty bill that President Bush and Congress have been trying to ram down our throats. The bill would have given more rights to illegal alients, who currently enjoy protection under U.S. law even though they broke the law by entering this country illegally.

Garcia-Ortega's case is typical.

His lawyer managed to get the illegal alien out on bail after the crash and even got an out-of-county judge to hear the case because the crash victim was a member of the Montgomery County Court.

A new judge was specially appointed to handle the case when Montgomery County judges were recused from handling the matter to avoid the appearance of impropriety, according to reporter Carl Hessler, who filed a story about the fugitive for The Mercury in Pottstown.

Imagine that. We wouldn't want the illegal alien to have to appear before a local judge. Montgomery County must pay for the expense to bring a judge from out of the region so the illegal alien can get a fair hearing.

Too bad the illegal fled the country before his fair hearing could be held.

Montgomery County Judge Thomas P. Rogers, 55, of Worcester, was injured during the 10:11 a.m. Dec. 17 crash at North Park Avenue and Amy Drive in Lower Providence. Authorities alleged a vehicle operated by Garcia-Ortega rear-ended Rogers' vehicle.

Garcia-Ortega, 23, was supposed to appear at Thursday's hearing during which Assistant District Attorney Wallis Brooks was seeking to revoke the $25,000 own recognizance bail that had allowed Garcia-Ortega to remain free pending trial on charges of accidents involving personal injury while not properly licensed and several summary traffic violations, according to Hessler's story.

"The commonwealth's concern at the time we filed the motion to revoke bail was that the defendant would flee the country," Brooks said. "Our concern proved valid when he in fact has fled the country."

Defense lawyer Patrick J. McMenamin Jr. told the judge he wrote to Garcia-Ortega on three occasions in preparation for Thursday's scheduled hearing but that he did not get a response.

However, McMenamin said he received a call Wednesday from Garcia-Ortega's interpreter, who advised that someone had driven Garcia-Ortega to Newark International Airport in New Jersey on June 20 to catch a flight to Guatemala.

"I assume that's what happened," McMenamin said.

McMenamin previously argued that Garcia-Ortega was not a risk to flee, claiming the man had resided at the same address since he came to the U.S. and that he lived and worked with relatives.

But McMenamin speculated Garcia-Ortega may have decided to flee because he feared languishing for a long time in county and federal custody before facing eventual deportation.

McMenamin believes Garcia-Ortega also was aware of news accounts about an Indonesian illegal immigrant who was sentenced this month to jail for driving without a license in connection with a fatal crash on the Northeast Extension of the Pennsylvania Turnpike and who faces deportation.

"I think that was of great concern to him. I think at that point in time that is when he probably made the decision," said McMenamin, speculating Garcia-Ortega may have believed that if he was going to be deported anyway he may as well go to Guatemala now.

County authorities plan to contact immigration officials to notify them about the turn of events.

"We would like to see him brought to justice. Obviously the matter is complicated now by the fact that he has left the confines of the United States and he's gone to a foreign country," Brooks said. "It is my hope that no matter how long it takes, be it weeks, months or years, somehow this man is brought to justice."

Authorities would also like to know who drove Garcia-Ortega to the airport. "I think that further investigation might be appropriate to determine exactly what transpired here with regard to this trip to Newark airport," Brooks said.

At the time of his arrest, Garcia-Ortega's bail was set at $50,000 cash. However, the bail was reduced to $25,000 unsecured at a January preliminary hearing under an agreement between police and defense lawyers in exchange for Garcia-Ortega's agreeing to waive the preliminary hearing, according to authorities.

Prosecutors then filed a request to revoke Garcia-Ortega's bail in April.

"We feel we did everything we could by filing the motion to revoke bail and being in a posture to aggressively pursue the charges," Brooks explained.

But a hearing on the bail revocation request was delayed pending the appointment of an out-of-county judge to hear the case.

A federal immigration detainer was not placed on Garcia-Ortega. County authorities speculated federal immigration officials don't necessarily detain illegal immigrants until they are convicted of crimes.

Prosecutors claimed Rogers, who is a former Lower Providence police chief, sustained "serious injuries" in the crash and was unconscious for more than two hours. In a criminal complaint, police said Rogers suffered injuries to the head and hospitalized.

This comedy of errors (actually a tragedy of errors) is exactly why the amnesty bill was defeated in the Senate.

An illegal alien who broke the law the day he entered this country violates traffic laws and injures a U.S. citizens (a judge no less). The illegal alien then manipulates the U.S. justice system to get out on bail and manages to flee the U.S. on a commercial flight.

Maybe we can have a legal scholar such as Sen. Ted Kennedy explain this to us.

Our government won't enforce the immigration laws already on the books. What makes you think adding new laws and making it easier for illegals to become citizens would deal with the problem of having 12 million undocumented aliens living in the United States?

We have to secure the border first, then address the problem of the illegals among us.
