United States Code, Title 8, Chapter 12, Subchapter II, Part VIII, §1325 - "Improper Entry by Alien," any citizen of any country other than the United States who: 1) Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or 2) Eludes examination or inspection by immigration officers; or 3) Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact; has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Will Illegal Aliens Decide Who Will Be America's Next President?

Whichever candidate finally wins in Florida and goes on to become our next President, he will have been put over the top by the votes of non-citizens -- including illegal aliens -- voting in mass numbers.

How could this be possible? Blame the National Voter Registration Act, commonly known as the Motor Voter law, which was signed into law on May 20, 1993 after passage by the slimmest of margins. Under this federal law, conceivably, millions of non-citizens and illegal aliens were automatically registered to vote when they applied for their driver's licenses or welfare benefits.

The Motor-Voter clearly states that "[e]ach State motor vehicle driver's license application (including any renewal application) submitted to the appropriate State motor vehicle authority under State law shall serve as an application for voter registration with respect to elections for Federal office unless the applicant fails to sign the voter registration application."

The Clinton Administration applied their famous "don't ask -- don't tell" strategy to the Motor Voter law's implementation by warning Motor Vehicle Department employees not to ask if an applicant is a citizen or tell them that non-citizens cannot vote.

Under the Motor Voter law, anyone [Motor Vehicle Department employees included] who "knowingly and willfully intimidates, threatens, or coerces, or attempts to intimidate, threaten, or coerce, any person for registering to vote, or voting, or attempting to register or vote" violates federal law.

Hence, the hundreds of thousands of illegal aliens, visa overstayers and others classified as "refugees" who were granted amnesty or asylum by the Clinton Administration could all have been illegal voters in this election.

How many ineligible voters actually took advantage of the Motor Voter law by registering to vote? In Florida, according to the Florida Secretary of State's numbers, between 1994 and 1998 (the most recent data available), the number of registered Hispanic voters skyrocketed by an astonishing 557%, from 99,000 to 655,000 while the number of White and Black registered voters increased by a reasonable 15 %.

The number of registered Hispanic voters has grown even more dramatically in south Florida. For example, in Dade County, from 1994 to 1998 the number of Hispanic voters grew by 1996%, a nearly 20-fold increase! And in now-famous Palm Beach County, the four year increase was completely off the charts, a 7,220% jump!

While Florida's numerous attractions and climate may have attracted new residents from other states, most would concede that this unbelievable spike in new voters must come mainly from one source -- new immigrants.

Certainly, there were resident aliens who applied for and were granted citizenship and, as a consequence were lawful voters in the 2000 election. Citizenship USA, the Clinton-Gore administration's high-priority immigration program achieved its goal of adding a million new immigrants to the voter rolls nationwide by 1996, waiving citizenship requirements wholesale to sign up as many voters as possible before the 1996 election.

But there were tens of thousands, if not hundreds of thousands, of ineligible voters who went to the polls and canceled out the votes of American citizens of all colors, races and creeds, men and women, including veterans who served with honor defending our system of Democracy.

How is it possible that the nation is in a frenzy over a handful of flawed ballots in Palm Beach but remains mute to the usurpation of America's most cherished possession -- the right to vote, by hundreds of thousands of illegal aliens and resident aliens?

In the 106th Congress, Rep. Bob Stump introduced legislation to repeal the Motor Voter law. This would be an excellent way to stop the process of registering non-citizens to vote. In the 105th Congress, Rep. Steve Horn introduced the Voter Eligibility Verification Act which would allow states to access a national database to reduce the incidence of non-citizens voting in U.S. elections. Unless American citizens don't mind the fact that their votes are being canceled out by non-citizens, they should contact their Representative and Senators, demanding the immediate passage of both of these bills.

New INS Report: 1986 Amnesty Increased Illegal Immigration

WASHINGTON (Oct. 12, 2000) � The report on America's illegal immigration crisis by the Immigration and Naturalization Service (INS), released today on Capitol Hill, highlights the profound unintended consequences of illegal-alien amnesties, just as Congress is considering another such amnesty. The report also makes clear, contrary to the conventional wisdom, that legal and illegal immigration are so intimately connected as to be two sides of the same coin. The report represents a genuine effort by the INS to examine this complex problem. The new estimates are the best to date and provide valuable new information for policymakers and the public. Among the findings, and their implications:

  • Amnesties clearly do not solve the problem of illegal immigration. About 2.7 million people received lawful permanent residence ("green cards") in the late 1980s and early 1990s as a result of the amnesties contained in the Immigration Reform and Control Act (IRCA) of 1986. But these new INS figures show that by the beginning of 1997 those former illegal aliens had been entirely replaced by new illegal aliens, and that the unauthorized population again stood at more than 5 million, just as before the amnesty.

  • In fact, the new INS estimates show that the 1986 amnesty almost certainly increased illegal immigration, as the relatives of newly legalized illegals came to the United States to join their family members. The flow of illegals grew dramatically during the years of the amnesty to more than 800,000 a year, before dropping back down to around 500,000 a year.

  • While it might be supposed that the increase in illegal immigration was caused only by the Special Agricultural Worker (SAW) provisions of the 1986 amnesty, the INS report indicates that this was not the case. Figures in the report itself show that illegal immigration surged more dramatically from countries other than Mexico. Since the vast majority of those amnestied under SAW were from Mexico, the increase should have been mostly Mexican if the SAW provision had been responsible for the surge.

  • Overall, the estimates show that nearly 500,000 illegal aliens settled here each year in the mid-1990s. This total number of new illegal settlers is offset by about 145,000 illegals who returned home on their own each year, 40,000 deportations, 20,000 deaths, and around 150,000 illegals receiving green cards as part of the normal "legal" immigration process.

  • The report clearly demonstrates that legal and illegal immigration are intimately linked, and not separate phenomena, as is commonly supposed. Between 1987 and 1996, the report states that 1.3 million green cards were given out to illegal aliens as part of the normal "legal" immigration process (189,000 in 1996 alone) � separate from the 2.7 million illegals who received legal status under the 1986 IRCA amnesty.

  • The 1.3 million green cards given out to illegals between 1987 and 1996 dwarf immigration enforcement efforts. According to the new estimates, only 335,000 illegals were deported or required to leave the country by the INS during the same period.

    "The fact that these new INS figures show that the last amnesty actually attracted more illegal immigration should give serious pause to those now advocating another amnesty," said Steven A. Camarota, Director of Research at the Center for Immigration Studies. "With the government estimating that nearly half a million illegal aliens settle permanently in the United States each year, the new estimates indicate that we have not yet regained control over our nation's borders."

    These numbers suggest that Congress's focus on border enforcement as almost the sole means of controlling illegal immigration is inadequate. Illegal immigration can be controlled only with a strategy that combines border enforcement with efforts to turn off the magnets that attract illegal aliens in the first place � jobs and green cards. Thus, the missing elements of our illegal immigration policy are muscular enforcement of the prohibition on hiring illegal workers and deep, permanent cuts in legal immigration.
